JBUJB Privacy Policy

  1. PRELIMINARY PROVISIONS

1.1 This Privacy Policy is that of JBUJB sarl, a company incorporated in Morocco, with the Common Enterprise Identification Number 003674803000067, headquartered at ZENITH BUSINESS CENTER, RUE MOUSLIM LOT BOUKAR, 3RD FLOOR APARTMENT NO. 14, BAB DOUKALA, MARRAKECH, and registered with the Commercial Court of Marrakech under file number 164501 (hereinafter also referred to as “JBUJB,” “we,” or “our”), as the owner and operator of the JBUJB Services. In this Privacy Policy, we collectively refer to all our products, services, websites, and applications as the “JBUJB Services.” For the avoidance of doubt, it is specified that the JBUJB Services do not include the processing of personal data that occurs in the context of entering into a contract between our clients and you as a natural person. Our clients are the following entities (which will independently act as data controllers if you enter into an agreement with them):

1.2 We respect the need for confidentiality and protection of personal information, including, but not limited to, any personal data. For the purposes of this Privacy Policy, the term personal data refers to any information relating to an identified or identifiable natural person, where an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

1.3 We always process personal data in accordance with this Privacy Policy and applicable legislation, in particular Law No. 09-08 on the protection of individuals with regard to the processing of personal data (hereinafter “Law 09-08”), its implementing regulations, as well as the guidelines and decisions of the National Commission for the Protection of Personal Data (CNDP).

1.4 Please read this Privacy Policy carefully to understand how we collect, process, and protect personal data if you use the JBUJB Services, and what your rights are in this regard. By using the JBUJB Services and/or providing us with personal data, you agree to be bound by this Privacy Policy and warrant that all personal data you provide to us is accurate and that you are authorized to provide it.

1.5 For the purposes of this Privacy Policy, unless the context requires otherwise, we shall be considered the data controller of personal data.

  1. CATEGORIES OF PERSONAL DATA

We collect, process, and protect the following categories of personal data:
Personal Data:

  • Email address;
  • First and last name;
  • IP address;
  • Phone number;
  • Postal address.

When using the JBUJB Services, we may ask you to provide the aforementioned personal data, which may be used to contact or identify you. If you provide respective consent, we may also use this personal data to contact you via newsletters, marketing or promotional materials, and provide other information that may be of interest to you.

  • Tracking and Cookie Data: We use cookies and similar tracking technologies to process personal data associated with the JBUJB Services. Please refer to Article 6 for more information.
  1. PURPOSES OF PERSONAL DATA PROCESSING

3.1 We process personal data for the following purposes:
a. Performance and compliance with our contractual and legal obligations, such as providing the JBUJB Services agreed upon between you and us – the legal basis for processing is the consent of the data subject and/or the necessity of processing for the performance of a contract to which the data subject is a party, in accordance with Law 09-08.
b. Direct marketing activities related to the JBUJB Services – the legal basis for processing is your explicit consent, in accordance with Law 09-08.
c. Detection, prevention, and resolution of technical issues – the legal basis for processing is our legitimate interest in ensuring the proper functioning of our services and preventing and correcting errors.
d. Improvement of the JBUJB Services – the legal basis for processing is your consent, in accordance with Law 09-08.
e. Conducting statistical analyses concerning cookies – the legal basis for processing is your consent, in accordance with Law 09-08.
f. Displaying commercial advertisements concerning cookies – the legal basis for processing is your consent, in accordance with Law 09-08.

  1. RETENTION AND TRANSFER OF PERSONAL DATA

4.1 We will retain and process personal data only for as long as necessary for the purposes set out in this Privacy Policy and only to the extent necessary to comply with our legal obligations, resolve disputes, exercise our rights, and protect our interests. In particular, we will process personal data for the following periods:
a. Personal data mentioned in Article 3.1 a) will be processed for the duration of our contractual and legal obligations.
b. Personal data mentioned in Article 3.1 b) will be processed until you object to processing for direct marketing purposes (e.g., opting out of newsletters or other marketing communications).
c. Personal data mentioned in Article 3.1 c) will be processed as long as you use the JBUJB Services.
d. Personal data mentioned in Article 3.1 d) will be processed as long as your consent is valid, and no later than the period of use of the JBUJB Services.
e. Personal data mentioned in Article 3.1 e) and f) will be processed in accordance with the characteristics of the cookies.

4.2 In the context of providing the JBUJB Services, the provision of data mentioned in Articles 3.1 a), b), and c) is a contractual obligation. Failure to provide this data will prevent us from providing the JBUJB Services. In the context of improving the JBUJB Services, conducting analyses, and displaying advertisements, the provision of data mentioned in Articles 3.1 d), e), and f) is voluntary. Failure to provide this data will make it impossible to tailor the JBUJB Services to your needs, conduct analyses, or display advertisements tailored to you.

  1. DISCLOSURE OF PERSONAL DATA

5.1 We may disclose personal data to third parties, including in the context of:
a. Providing the JBUJB Services: The recipients of your personal data are entities that cooperate with us, in particular our subcontractors and partners. Any transfer of personal data outside Morocco is carried out in compliance with the requirements of Law 09-08, in particular by ensuring an adequate level of protection for the transferred data.
b. Business Transactions: We may disclose personal data to any third party that acquires all or substantially all of our business, shares, or assets, or with which we merge or undergo any other form of corporate restructuring. In such cases, we will inform the third party of the obligation to process personal data in accordance with this Privacy Policy.
c. Law Enforcement Disclosure: We may, under certain circumstances, be required to disclose personal data pursuant to the law or in response to requests made by public authorities (e.g., a competent Moroccan court or government agency).
d. Legal Requirements: We may disclose personal data if we believe in good faith that such disclosure is necessary to: (i) comply with a legal obligation, (ii) protect and/or defend our rights or property, (iii) prevent or investigate possible wrongdoing in connection with the JBUJB Services, (iv) protect the safety of users of the JBUJB Services or the public, (v) protect against legal liability.

The recipients of personal data may be located outside Morocco. Transfers of personal data to countries that do not offer an adequate level of protection, as recognized by the CNDP, will be subject to appropriate safeguards, such as standard contractual clauses approved by the CNDP.   1. TRACKING, COOKIES, AND IP ADDRESSES

6.1 Cookies are computer files containing a small amount of data that may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also use web beacons, tags, and scripts to collect and track information and to improve and analyze the JBUJB Services. Cookies allow us to recognize whether you have accessed our website from the same device, record certain stored settings, and verify whether you belong to a particular category of users to whom certain communications should be targeted.

  1. DIRECT MARKETING

7.1 By (i) granting respective consent to direct marketing during registration as a user of the JBUJB Services or granting respective consent while using the JBUJB Services without prior registration, or (ii) granting respective consent when subscribing to marketing communications, surveys, etc., you agree that we may use your electronic contact details to contact you electronically (e.g., via email) with marketing information.

7.2 You may unsubscribe from marketing communications by disabling this function via the unsubscribe link provided in each email or other communication you receive, or by sending a request via email to info@jbujb.ma.

7.3 You may also grant additional consent to direct marketing to our clients under the terms set out in their respective privacy policies, either (i) by granting respective consent to direct marketing during registration as a user of the JBUJB Services or while using the JBUJB Services without prior registration, or (ii) by granting respective consent when subscribing to marketing communications, surveys, etc., when you agree that they may use your electronic contact details to contact you electronically (e.g., via email) with marketing information. However, this consent is entirely governed by their internal privacy policy, and we are not responsible for it in any way.

  1. SECURITY

8.1 We are committed to securely storing all personal data. Accordingly, we have implemented appropriate physical, technical, and organizational measures and plans to protect and secure personal data (which, however, does not exempt you from your responsibility to take appropriate measures to secure your data, particularly for data transmission). Our goal is to eliminate any unauthorized or unlawful processing of personal data as well as any accidental, unauthorized, or unlawful access, use, transfer, processing, copying, transmission, alteration, loss, or damage to personal data.

8.2 Where we have provided you (or where you have chosen) a password that enables you to access certain parts of the JBUJB Services, you are responsible for the strength and confidentiality of that password. We ask you not to share the password with unauthorized persons.

8.3 Unfortunately, the transmission of information over the Internet is never completely secure. While we do our best to protect personal data, we cannot guarantee the security of personal data you transmit to us. Any such transmission is at your own risk to the extent that we cannot reasonably secure it. However, once we receive personal data, we will use strict procedures and security measures to protect it and prevent unauthorized access.

8.4 To maintain the highest level of personal data protection, all information you provide is stored on secure servers behind firewalls. We limit access to personal data to employees, subcontractors, and agents who need to know this personal data to operate, develop, or improve the JBUJB Services.

8.5 Certain parts of the JBUJB Services that collect personal data also use SSL (Secure Sockets Layer) encryption or other types of encryption. We back up all customer data in the data center located in Frankfurt (Germany), enabling rapid recovery in case of a disaster or similar event, and whenever possible, we will ensure the pseudonymization or anonymization of all personal or related data (except for names and email addresses).

  1. YOUR RIGHTS

9.1 Subject to the rules and conditions set out in Law 09-08, you have or may have the following rights regarding your personal data:
a. Right of Access: You are entitled to request confirmation from us as to whether personal data concerning you is being processed and, if so, you may access additional information about this processing. Your right of access may be exercised in accordance with applicable legislation. However, where your requests are manifestly unfounded, excessive, or repetitive, we may either:

  • Charge reasonable fees, taking into account the administrative costs associated with taking the requested actions; or
  • Refuse to act on the request.
    b. Right to Erasure (Right to be Forgotten): You are entitled to request the erasure of personal data concerning you without undue delay, and we are obligated to erase such data without undue delay if the respective conditions under Law 09-08 are met. Please note that erasing your personal data may result in our inability to provide our services.
    c. Right to Rectification: You are entitled to request the rectification of inaccurate or incomplete personal data concerning you without undue delay.
    d. Right to Object: You are entitled to object, on grounds relating to your particular situation, at any time, to the processing of your personal data.
    e. Right to Restriction of Processing: You are entitled to request the restriction of the processing of your personal data.
    f. Right to Data Portability: You are entitled to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format, and you have the right to transmit this data to another data controller without hindrance from us.
    g. Right to Withdraw Consent: Where processing is based on consent, you are entitled to withdraw your consent at any time. This withdrawal does not affect the lawfulness of processing based on your consent prior to its withdrawal.

9.2 If you believe that your personal data has been processed unlawfully, please contact us at info@jbujb.ma, and we will resolve the issue.

9.3 Please keep in mind that we respond to all requests within 30 days. Any requested changes, once we have verified your identity and the legitimacy of the request, may take up to five (5) business days to take effect.

  1. SURVEYS AND TESTIMONIALS

10.1 From time to time, we may request information through surveys. Participation in these surveys is voluntary, and you may choose whether to participate and disclose the requested information. The requested information may include contact details (such as name and email address) and organizational information (organization name, position). Contact details will be used to share results if the participant chooses to receive them. Survey information will be used for research, monitoring, or improving the user experience and satisfaction with the JBUJB Services.

10.2 From time to time, we may also publish various texts such as testimonials, quotes, case studies, white papers, etc., on our websites that may contain personal information. We will obtain your consent to publish your name with such text. If you wish to update or remove a text containing your personal information, please contact us at info@jbujb.ma.

  1. FINAL PROVISIONS

11.1 We use a consent management application to facilitate the management of your preferences regarding cookies and other tools. You can use the aforementioned application to modify your cookie settings, including granting and withdrawing consent for the use of optional cookies.

11.2 The JBUJB Services may, from time to time, contain links to and from the websites of our partner networks, advertisers, and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies, and we accept no responsibility for those policies. Please review these policies before submitting personal data to these websites.

11.3 The JBUJB Services are not directed to anyone under the age of 18. We do not knowingly collect personal data from individuals under 18. If you are a parent or guardian and are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from children without verification of parental consent, we will take steps to remove that information from our servers.

11.4 We reserve the right to modify, amend, supplement, or otherwise change this Privacy Policy at any time and for any reason. Any new version of this Privacy Policy supersedes its previous version as of the effective date of the new version.
